The following are terms and conditions of coach hire of Highland Translink Ltd (hereinafter called the company). They form the basis of the contract under which the company agrees to hire its vehicles to the customer (hereinafter called the hirer) whether a contract has been made verbally or in writing.
Quotations are made subject to a vehicle fitting the hirer's requirements being available at the time of acceptance. They are valid for 28 days from issue or a specified date. Unless
otherwise stated quotations will not include payment of tolls, ferry charges, parking fees, accommodation or
Unless prearranged with the company, the vehicle is not available for the use of the hirer other than the outward and return journeys.
The number of passengers carried shall not exceed the number of seats on the vehicle and all passengers should wear the seat belts provided at all times.
4 Change of Vehicle
The company reserves the right to provide, without notice to the hirer, a larger than specified vehicle at no extra charge to the hirer. The company also reserves the right to substitute other vehicles of similar quality including those from other operators for part or all of the hire.
5 Journey Times and Drivers Hours
Should a vehicle be detained by the hirer, or taken on a longer journey than contracted for, the company reserves the right to charge the hirer for any additional costs incurred. The driver, at all
times, must be the judge of any request from the hirer to a change of route or timing. The current regulations governing drivers hours and rest periods must be adhered to and the company reserves
the right to alter or curtail any journey which does not comply with the regulations.
6 Breakdowns or Delays
The company gives its advice on journey times in good faith, but, as a result of a breakdown, traffic congestion or any other circumstances beyond our control the company will not be liable for any
loss or inconvenience caused.
7 Personal Property and Injury
The company will not be responsible for any damage to or any loss of personal property left in the vehicle however caused. The company will not accept any liability for damage, injury or loss by any
passenger standing up, boarding, alighting or moving around the vehicle whilst it's in motion. The hirer shall be responsible for the conduct of the passengers and for any damage caused, wilful or otherwise, by the passengers to the vehicle during the hire.
A 10% deposit is paid at the time of booking and payment in full must be made no later than 7 days prior to the date of the hire unless other payment terms have been agreed in writing. The company reserves the right to cancel the contract if these conditions have not been adhered to thus resulting in the loss of the deposit by the hirer.
9 Cancellation by the Company
In the event of an emergency or force majeure, resulting in cancellation by the company, a full repayment will made to the hirer thus removing any further or other liability by the company.
10 Cancellation by the Hirer
The company reserves the right to charge a cancellation fee on the following scale:
(a) Cancellation 30–15 days prior to hire Loss of Deposit
(b) Cancellation 14–2 days prior to hire 50% of hire charge
(c) Cancellation within 48 hours prior to hire 100% of hire charge
11 Airport or Ferry Transfers
The coach will wait for up to 1 hour after the pre-arranged collection time to allow for arrival delays, thereafter any additional waiting time will be charged at the discretion of the company.
No hot food is allowed to be consumed on the coach. Small items of confectionary and soft drinks are permitted.
13 Alcohol / Smoking Policy
The company operates a strictly No Smoking policy and forbids the carrying and consumption of alcohol on board. Would the hirers please bring the above to the attention of all passengers
intending to travel on the coach.
In the unlikely event you wish to complain about our services please do so in writing within 14 days of the end of the hire. No correspondence will be entered into unless we are
notified within the time specified.
These conditions and also any contract made between Highland Translink Ltd and the hirer shall be governed by Scottish Law. In the event of any dispute, both parties agree to submit to the exclusive
jurisdiction of the Scottish Courts.
